David Poulton (Partner, Victoria) is a highly regardedadvisory and litigation lawyer who advises on insurance and corporate risk and media litigation. David regularly acts for insurers, related entities and corporations in a wide range of insurance and liability matters and has particular expertise in public and product liability claims and class actions.
David has extensive government experience that includes many years' experience in advising the Victorian State Government in relation to risk management and litigation issues. He also works extensively in the Insurance and Media and Communications industries.
David has drafted insurance policies and advised on existing policies. He has managed a substantial portfolio of personal injury claims including product liability, workers’compensation, WorkCover, toxic torts, asbestos litigation and medical negligence. His strong media litigation credentials include providing advice in defamation and contempt cases, as well as providing pre-publication advice to various publishers. David’s significant administrative law experience includes acting in disciplinary matters on behalf of various sporting bodies, primarily in the racing industry. His diverse and far reaching experience extends to maritime law and litigation, as well as advising educational bodies in relation to legal issues in schools and other educational institutions.
David is experienced in handling matters in courts throughout Australia, including appeals to the Court of Appeal and High Court on behalf of Worksafe Victoria. His impressive track record in class actions and mass tort litigation includes the Kraft Peanut Butter class action, which resulted in the first ever settlement of a Federal Court class action under the product liability provisions of the Trade Practices Act. David also acted as Independent Claims Administrator in connection with the efficient adjudication of over 3000 claims arising from the Dow Corning Breast Implant Australian Settlement Scheme, a long running class action. The handling of the settlement received public commendation from the Supreme Court Judge in charge of the proceeding.
David provides strategic advice to Victorian WorkCover Authority in relation to all aspects of its business and is an advisor to WorkSafe Victoria on administrative law matters. His other longstanding clients include: The Age Company Ltd, Racing Victoria Ltd, and The Department of Education and Early Childhood Development.
He regularly speaks at seminars and conferences held by industry associations such as NIBA, the Australian and New Zealand Institute of Insurance and Finance and the Australian Insurance Law Association National Conference.
