The Bribery Act 2010: Implications for Australasian companies doing business in the UK

The Ministry of Justice has released draft guidance on what commercial organisations will have to do to comply with the Bribery Act 2010 when it comes into force next year. The Act will apply to foreign companies and partnerships with a business presence in the UK, regardless of where the offending activity occurs.

In-house counsel communications: Not subject to legal professional privilege in the EU

The European Court of Justice has confirmed that internal communications with in-house counsel are not protected by legal professional privilege and may be inspected by the European Commission in cartel investigations. This decision reinforces the divergence between the EU position and that in Australia and New Zealand.

Equality Act 2010 now in force

Most provisions of the Equality Act 2010 came into force on 1 October 2010. The Act is now the key piece of legislation governing discrimination in the UK, and seeks to update the previous regime by introducing a number of changes.
