Brendan provides general corporate and governance advice to senior company management and boards of directors.

Brendan has wide experience advising power generators on diverse sector issues. His expertise includes the structuring, finance, construction and operation of major generation projects, fuel procurement and tolling arrangements, connection and access arrangements, power supply arrangements and relevant regulatory matters.

Brendan acts for governments, government owned entities and private sector developers of complex infrastructure and logistics projects. He has particular expertise in coal export terminal projects, power generation projects and water infrastructure projects. Brendan advised:

• NQBP on the divestment of Terminal 1 at Abbot Point;
• Seqwater on the acquisition of Wyaralong Dam from Queensland Water Infrastructure by regulation made under the South East Queensland Water (Restructuring) Act 2007;
• Tarong Energy in connection with the 2011 Queensland State Owned Generator restructure.

Brendan advises on a range of share and asset acquisition and divestment transactions in the energy and resources sectors. Recent deals include acting for Tarong Energy Corporation on its acquisition of the 50% interest in Tarong North Power Station, held by the Tokyo Electric Power Company and Mitsui.

Brendan is a specialist advisor to the mining industry. His expertise includes exploration tenement and mining lease acquisitions, overlapping tenure and competing land use issues, project procurement and mining service contracting, private royalty arrangements, rail transportation and port access arrangements and commodity sale contracts.

Brendan has specialist oil and gas sector experience. His advisory includes farm-in transactions, joint venture and joint operating agreements, overlapping tenure and competing land use issues, drilling contracts and other procurement and service contracting, pipeline corridor development, gas sale and transportation arrangements and associated water regulation.

Recognised as one of Australia’s leading water lawyers, Brendan provides specialised advice to water sector participants and mining and petroleum companies on water issues arising from their operations. His experience spans all aspects of water access and regulation including acquiring and disposing of water entitlements, supply arrangements, operation and maintenance agreements for water infrastructure, and regulatory compliance matters for service providers and water-related infrastructure.
