Electricity regulation

The regulations governing electricity have changed significantly during the past decade. Our team has advised on every aspect of the Australian energy regulatory environment. This includes advising on all phases of the National Electricity Code through the restructuring of the energy market and introduction of the new institutional arrangements through the Australian Energy Regulator, Australian Energy Market Commission and Operator, and the National Electricity Law and National Electricity Rules.

We have acted for governments and industry participants, advising on the Australian regulatory frameworks for electricity distribution and retailing in all states and territories.

Our experience involves giving advice in the context of regulated, semi-regulated and unregulated assets, together with representing clients in actions by the AER, making submissions to the ACCC and other authorities such as the Queensland Competition Authority.

Merger of Ergon and Energex

Advised on all aspects of the merger between State-owned energy companies Ergon Energy and Energex, including review of legislation, development of implementation plans, due diligence and establishment of relevant corporate entities.

Solar Energy Plant

Advised Rio Tinto on its offtake contract from a solar energy plant at Weipa.

Assisting an international investor with due diligence on the potential acquisition of an Australian utilities solar plant.

Macquarie Generation asset sale - acting for bidder

Acted for one of the three short-listed bidders for the purchase of New South Wales' electricity generation assets from Macquarie Generation.

Boyne Island Aluminiuim Smelter

Advised Boyne Smelters Limited on both long and short term contracts for the purchase of additional electricity for the Boyne Island Aluminium Smelter and related transmission arrangements. The work included advice on tender documentation, AFSL considerations and developing novel contract structures to operate within the National Electricity Rules.
