Biography

Phillip has more than 20 years' experience in the area of construction, engineering and infrastructure. He has extensive experience in contract drafting, contract administration advice and dispute resolution.

Phillip's expertise has come from working on a large variety of projects for different participants and has included:

  • considerable work for government agencies focusing particurlarly on public sector contracting principles and Government Codes of Conduct
  • many high rise apartment projects that are impacted by the Domestic Building Contracts Act, from the perspective of developer, contractor, purchaser and financier
  • working for both government and the private sector in relation to the franchising of the Melbourne public transport system (both phases)
  • significant disputes for both government and the private sector, most recently including the Murrin Murrin arbitration, one of the largest construction arbitrations conducted in Australia.

To assist in enhancing clients' understanding of risk allocation in commercial contracts and the inherent and particular risks in disputes, Phillip uses a number of technical tools. His interest in project management was well utilised in the Murrin Murrin arbitration (which involved, at times, in excess of 20 lawyers in a dispute lasting more than four years) and in EastLink (formerly the Mitcham Frankston Project).

Phillip often presents seminars to numerous organisations, including the Housing Industry Association, Building Dispute Practitioners Society and University of Melbourne on a variety of topics, including effective contract management, improving contractor and consultant performance, insurance law for the construction industry and dispute avoidance.

He is a member of the Institute of Arbitrators and Mediators, Australia, and a former President of the Building Dispute Practitioners Society.
