Biography
Mark has specialised knowledge in dispute resolution and litigation acting for government, insurance and banking clients. He manages a defendants litigation-based practice focusing on all areas of tort law including advising on lead poisoning, chemical, fume, dust and asbestos torts. He is experienced in class and representative actions and with insurance law disputes. Mark also manages commercial litigation recovery work particularly for banking/lending recovery. He is experienced in alternative dispute resolution mechanisms having completed LEADR mediation and University of Windsor Law School ADR Workshop courses.
During more than 20 years' experience in all areas of banking, commercial, construction and insurance disputes, Mark has personally managed work for many of Australia's largest insurers lenders and in the public sector for agencies covered by Comcare, Comcover, the ACT Default Insurance Fund and Defence Service Homes Insurance.
Mark develops strategies to resolve or manage disputes prior to the commencement of litigation, ensuring that the strategic management of potential disputes accords with his clients protocols or obligations. He ensures that management of disputes has client input at all stages to achieve beneficial outcomes consistent with his client's expectations.
He also advises on the application and interpretation of legislation and the interpretation of contractual arrangements in a wide range of disputes. Mark has advised on disputes including claims for contribution or indemnity involving construction related works, which have involved specialised evidentiary aspects.
His extensive insurance policy interpretation and interstate jurisdictional experience has been used by public sector agencies operating under the Australian Government's self insurance agency, Comcover, and also for common law claims falling outside the Comcover scheme.
