ACCC announces enforcement priorities for 2018

ACCC Chairman Rod Sims has announced the Commission’s Compliance and Enforcement Priorities for 2018. We look at key outtakes from his speech and how we can assist businesses in response to this year’s priorities.

In a speech delivered on the 20th February, Rod Sims launched the ACCC’s Compliance and Enforcement Policy and Priorities for 2018. Delivered annually, this speech provides valuable insights into the industries and types of conduct on which the ACCC will focus their resources in the year ahead. Mr Sims foreshadowed an emphasis on the financial services, energy, construction and TMT sectors in 2018, as well as increased scrutiny of large and national franchisors.

Increased focus on TMT

Mr Sims highlighted competition issues in the technology and media sectors, including the use of digital platforms, algorithms and consumer data, with a focus on emerging markets. The ACCC will also be pursuing consumer issues in the provision of broadband services, particularly speed representations.

Enduring priorities

As always, the ACCC will continue to prioritise cartel and other anti-competitive conduct (including the new misuse of market power and concerted practices laws), product safety and conduct impacting vulnerable and disadvantaged consumers and indigenous Australians.

Large National Franchisors

The ACCC will continue to prioritise the protection of small business, which this year will involve focusing on ensuring large and national franchisors are complying with their obligations under the Franchising Code of Conduct.

Industries in the spotlight

The ACCC will be focusing on conduct in the following industries in 2018:

  • Competition issues in the financial services sector and commercial construction industry
  • Consumer issues in the new car retailing industry
  • Competition and consumer issues in the energy and agricultural sectors
