Construction Law Update October 2018

Increased legislative activity in the parliaments of the Commonwealth (regarding government procurement), New South Wales (certifier regulation), and Queensland (project bank accounts) are highlighted this month.

In the courts, a standout decision in New South Wales considered whether a defect before practical completion is a 'temporary disconformity' or breaches the building contract. Another case in Western Australia concerns the courts’ powers in respect of interim measure like freezing orders during arbitration proceedings to prevent abuse of judicial processes.
