MinterEllison has boosted its Tax Controversy team with the appointment of Mark Konza PSM, previously Deputy Commissioner – International at the Australian Taxation Office.

At the ATO, Mark was responsible for developing and leading the organisation's strategy on base erosion and profit shifting, offshore tax evasion and foreign investment risks. During his time, he led winning tax settlements with Microsoft, Google, Facebook and other large multi-national enterprises.

He was also responsible for the small and medium enterprises business line where he designed an audit-based methodology to administer the income tax system for business and individual taxpayers across the SME market as well as high wealth individuals, non-profit sector and government organisations.

"Mark's move to MinterEllison is part of our deliberate and focused strategy to provide our growing list of local and cross-border clients with access to tax controversy and transfer pricing experts, who know how to work with the ATO and navigate a complex international tax landscape", says Carmen McElwain, Head of Tax Controversy.

"His unique expertise spans tax technical and management roles across debt management, taxpayer assistance, assessments, rulings, disputes and audits at various levels in large, small and medium business and individual tax segments."

"He brings a new level of perspective to tax issues encountered by our clients through his deep knowledge and decades of experience at the ATO."
Mr Konza said MinterEllison's standing as Australia's largest law firm attracted him to the firm.

"MinterEllison's reputation as one of the country's leading tax controversy and transfer pricing practices and its work on landmark matters drew me to the firm. I'm looking forward to sharing my expertise and knowledge and working with a team who continue to test, and clarify, the application of Australia’s suite of legislation aimed at multinationals who do business in the region," said Mark Konza.

MinterEllison is the only law firm in Australia with a dedicated tax controversy team with national capability and longstanding experience advising large businesses on their management of a full range of tax issues, from ATO review to litigation. The tax controversy team is also a longstanding trusted adviser to the ATO. In recent years the firm has conducted some of the most significant tax cases on behalf of the ATO in Australia and globally, including:

  • Commissioner of Taxation in Australia v Bogiatto (No 2) [2021] FCA 98
  • Commissioner of Taxation in Australia v Chevron Australia Holdings (CAHPL)
  • Commissioner of Taxation in Australia v Resource Capital Fund IV LP 1
  • Burton v Commissioner of Taxation [2019] FCAFC 141

The Firm has continued to grow its tax controversy team at the partner level as well – with the recent internal promotion of Farzeen Anwar.
