Property and Leasing

Our national Property and Leasing team work with government departments, agencies and statutory authorities at federal, state/territory, and local government levels to assist with leasing portfolios and ensure continuity of tenure and security of our clients' business operations. Our fully established, cross-jurisdictional leasing team routinely advises on rent review methodologies, service standards, lessor warranties, indemnities and contingent liabilities, issues that arise for landlords and tenants and compliance with Commonwealth policies.

We work closely with our government clients to set up project development strategies to more effectively manage these large scale and complex developments. We are often involved from the outset through to completion and increasingly beyond, into management and maintenance requirements for the life of the asset.

Our property team has advised on several of the most significant and complex property projects undertaken by government in recent times including advising the Victorian Government on the Melbourne Docklands Redevelopment and partnering with Urban Growth NSW, Government Property NSW, RMS and Treasury NSW, along with other government agencies on significant urban renewal and property development matters.

We have a comprehensive understanding of the complexities of large scale real estate acquisitions and disposals. In addition to acting for government clients, our team brings leading industry expertise acting for consortia and financiers on their conveyancing of commercial and industrial sites, greenfield sites, development of land and government infrastructure. Our expertise encompasses general property law advice and transactional work on complex issues or major transactions, strata and community title, and complex commercial and residential leasing and licensing. We also have a strong track record in advising our public sector clients on property development and disposal strategies, conveyancing of multiple or major land parcels, through to property dealings including easements, land access agreements and covenants.

Port Botany and Port Kembla Transaction

Advised the New South Wales Government (NSW Treasury) on the refinancing of Port Botany and Port Kembla in NSW. The project was unique, involving the contemporaneous refinancing and long term lease of two major Australian ports. Our role included extensive legal analysis of the existing assets and businesses and the regulatory landscape; recommending a transaction structure; drafting special transaction legislation; asset restructuring; preparing extensive interrelated transaction documents; tender process and negotiations; and implementation under legal project management. The project was complex and very significant for NSW, with the transaction widely considered to establish a new benchmark in transaction preparation and execution.

$800m Discovery Point mixed use development

Acting for a wholly owned subsidiary of Frasers Property Australia (formerly Australand Holdings Ltd) on the A$800 million Discovery Point development at Wolli Creek in New South Wales. This 8-hectare mixed use development will feature residential apartments, commercial offices, an integrated retail centre and extensive public and private parklands. We are advising on procurement and OH&S strategies, drafting pro-forma and project specific documentation (such as consultancy agreements and design and construct contracts), assisting in the preparation of the tender conditions, advising on the tendering process and compiling documentation for tender.
