MinterEllison has launched the latest edition of its Insurance Contracts Act Handbook, a market-leading publication that has served as a trusted reference for the Australian insurance sector for over 30 years.

The Handbook is an authoritative, practical overview of Australia's Insurance Contracts Act 1984. The latest edition captures all amendments to the Act, provides a concise summary of case facts and principles, and points to practical implications from important case law developments since 2021, when the previous edition was published.

This edition was launched by Joanna Mercer, Head of Claims, Everest, to more than 100 high profile industry guests from major financial services and insurance companies, as well as partners and teams from MinterEllison.

In launching the 12th edition of the handbook, Joanna Mercer described the handbook as an "indispensable resource", which has "become a publication that all of us in the industry rely on".

Mercer also praised the handbook for "consistently providing the highest calibre updated insights, legal commentary and practical guidance", over many editions.

New in the 12th edition

Since the last edition, there has been a continued rise in cases on the duty of utmost good faith under section 13 and an indication that the duty may not be as far-reaching as initially thought. The sector will also be affected by a number of cases on notification of facts that might give rise to a claim under section 40(3).
